Terms of Use
Soulfia is not medical advice and is not for emergencies. If you are in crisis or thinking about harming yourself or someone else, stop using the app and get help now: call your local emergency number. In the United States, call or text 988 to reach the 988 Suicide & Crisis Lifeline.
1. Acceptance of these terms
These Terms of Use (“Terms”) are an agreement between you and Nicholas Robinson, the individual developer of Soulfia (“we”, “us”, “our”). They apply to the Soulfia mobile app and the online services behind it (together, “Soulfia”). By downloading, accessing or using Soulfia, you agree to these Terms. If you do not agree, do not use Soulfia.
Our Privacy Policy explains how we handle your information and is part of how Soulfia works, so please read it too.
2. Not medical advice
- Soulfia offers guided meditations for relaxation and general wellbeing. It is not a medical, psychological, therapy or counseling service, and it does not diagnose, treat, cure or prevent any condition.
- Nothing in Soulfia is medical advice or a substitute for care from a qualified professional. If you have a physical or mental health condition, or questions about your health, talk to a doctor or other qualified professional. Never ignore professional advice or delay seeking it because of something you heard in Soulfia.
- If you are in crisis, call your local emergency number. In the United States, call or text 988. Soulfia cannot respond to emergencies.
- Do not listen to meditations while driving, operating machinery, or doing anything that needs your full attention. Stop any exercise that makes you feel unwell, dizzy or distressed.
3. Eligibility
You must be at least 13 years old, or older if the law where you live requires it, to use Soulfia. If you are under the age of legal majority where you live, you may use Soulfia only with the permission of a parent or guardian, who must also approve any purchase. You may not use Soulfia if the law prohibits you from doing so.
4. Your account
- You need an account to create meditations. You can sign up with an email address and password, Sign in with Apple, or Google sign-in. Explore can be browsed without an account.
- Give accurate information, keep your sign-in details secure, and do not share your account.
- You are responsible for what happens under your account. Tell us promptly at roycerobins95@gmail.com if you think someone else has used it.
- Your display name and avatar are shown with any meditation you make public, so do not use a display name that you do not want others to see, or that belongs to someone else.
- If you sign in with Google, your avatar is your Google profile photo, and it is shown with any meditation you make public even though your name is not. The app cannot change or remove it yet. Email roycerobins95@gmail.com and we will remove it.
5. Subscriptions and purchases
- Each account can create a few personalized meditations for free; the app shows how many are left. A free meditation that fails to generate does not count. Creating more requires “Premium”, which you get with a paid subscription or, if offered, a one-time purchase. Prices, billing periods and any free trial or introductory offer are shown in the app before you buy.
- Purchases are made through the Apple App Store or Google Play and are billed by them to the payment method in your store account when you confirm the purchase. We do not process or receive your payment details.
- Subscriptions renew automatically at the end of each billing period, at the then-current price, until you cancel. On the App Store, subscriptions renew unless cancelled at least 24 hours before the end of the current period, and your account is charged for the renewal within the 24 hours before the period ends. On Google Play, cancel any time before the renewal date to avoid the next charge.
- Free trials and introductory offers: if you are eligible for one, it converts to a paid subscription at the end of the offer unless you cancel in time: at least 24 hours before it ends on the App Store, or before it ends on Google Play. Eligibility is decided by the store. On iOS, any unused part of a free trial is forfeited when you buy a subscription.
- One-time (Lifetime) purchase: if a one-time purchase is offered, it gives you Premium for as long as Soulfia offers Premium. It is not a subscription and does not renew.
- To cancel, use your store’s subscription settings: on iPhone, go to Settings > [your name] > Subscriptions; on Android, open Google Play > Profile > Payments & subscriptions > Subscriptions. You can also reach these from the Subscription screen in the app. Cancellation stops the next renewal; you keep Premium until the end of the period you already paid for.
- Deleting the app or your Soulfia account does not cancel your subscription. Cancel it in the store first, or you will keep being billed.
- Refunds are handled by Apple or Google under their refund policies. We cannot issue refunds for store purchases ourselves.
- Price changes follow the store’s rules, including any notice or consent they require.
- iOS purchases: if you downloaded Soulfia from the Apple App Store, Apple’s Licensed Application End User License Agreement (Standard EULA) also applies to your use of the app and your purchases. See also section 17.
6. AI-generated content
- Soulfia uses artificial intelligence services to write each meditation from your answers and to narrate it with a synthetic voice. Meditations are generated automatically, and we do not review them before you hear them.
- AI output can be inaccurate, unexpected, repetitive, or not right for you, and similar meditations may be generated for other people. Use your own judgment, and stop listening if something does not feel right.
- AI-generated content is not professional advice of any kind (see section 2).
- Your answers are processed by our AI providers as described in the Privacy Policy. The app asks for your permission before it sends them, and you can withdraw it at any time in Settings > AI data & consent. Without it, you cannot create or publish meditations.
- If the AI writes or says something offensive or harmful in one of your meditations, public or private, tap … next to it in the Library tab (or … in the player) and choose Report a problem. We review these reports within 24 hours. Reporting does not change who can see the meditation.
7. Your content and published meditations
- Your answers. You keep any rights you have in the text you enter. You give us permission to store and process it, and to send it to our service providers, in order to create, store and deliver your meditations and to run Soulfia as described in the Privacy Policy.
- Meditations generated for you. As between you and us, we do not claim ownership of the scripts generated from your answers. You may listen to and use your meditations for your own personal, non-commercial purposes. The voices, background sounds and other parts of Soulfia used to make them remain ours or our licensors’.
- Published meditations. When you make a meditation public, you give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display and stream it (including its title, introduction, tags and audio, with your display name and avatar) to other people through Soulfia, including people who are not signed in, for as long as it stays published. This license ends when the meditation is removed, except for copies that remain for a limited time in backups.
- Removing a meditation. In the app’s Library tab, tap … next to a meditation and choose Make private to take it off Explore, or Delete to remove it permanently. Deleting your account removes all of your meditations.
- Your responsibility. You are responsible for what you enter and what you choose to publish. Do not include other people’s personal information or anything you do not have the right to share.
- Moderation. Meditations you choose to make public go through an automated safety check and stay private if they do not pass. We may also remove or make private any meditation, or restrict publishing, if we believe it breaks these Terms or could harm others.
- Reporting. To report a public meditation, tap … on it in Explore (or Report on its page, or … in the player) and choose a reason. You can also email roycerobins95@gmail.com with its title (a screenshot helps). We review reports within 24 hours. We remove content that breaks these Terms, and we may suspend or end the account of the person who published it (see section 11).
- Automatic removal after repeated reports. When three different people have reported the same meditation, it is taken off Explore automatically and made private until we have reviewed it. Its creator cannot publish it again while the review is open. If we find it does not break these Terms, we can restore it.
- Hiding creators. You can hide a creator so that none of their meditations appear for you in Explore. They are not told. You can unhide them at any time in Settings > Hidden creators.
8. Acceptable use
When using Soulfia, you agree not to:
- break the law, or help anyone else break it;
- enter or publish content that is hateful, harassing, threatening, sexually explicit, violent, or that promotes self-harm or harm to others;
- enter or publish other people’s personal information, or content that infringes someone else’s rights;
- try to make the AI produce harmful content, or to get around our safety checks;
- misuse reporting, for example by reporting content you know does not break these Terms;
- impersonate anyone or misrepresent your connection to anyone;
- access another person’s account or private data, or try to get around usage limits, security measures or payment requirements;
- copy, scrape, resell or commercially exploit Soulfia or its content, or use automated means to access it, except as allowed by law;
- reverse engineer, decompile or interfere with Soulfia or its servers, except where the law allows it despite this restriction; or
- overload or disrupt Soulfia, or introduce malware.
9. Soulfia’s content and your license to use the app
Soulfia, including its software, design, text, voices, music, sounds and graphics, belongs to us or our licensors and is protected by intellectual property laws. Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable, revocable license to use the Soulfia app on devices you own or control, for your own non-commercial use. All rights not expressly granted are reserved.
If you send us feedback or suggestions, we may use them without any obligation to you.
10. Third-party services
Soulfia relies on third-party services, such as Apple and Google for sign-in, purchases and notifications. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.
11. Ending your use and termination
- You can stop using Soulfia at any time. You can delete your account in the app at Profile > Settings > Account > Delete account, or by following the steps on our account deletion page.
- We may suspend or end your access to Soulfia, or remove content, if you break these Terms, if required by law, or if needed to protect Soulfia, other users or the public. Where reasonable, we will tell you why.
- Ending your access does not cancel a store subscription; cancel it in the store.
- Sections that by their nature should continue after termination (including sections 6, 7, 9 and 13 to 16) will continue to apply.
12. Changes to the service
Soulfia is developed by one person and will keep changing. We may add, change or remove features, voices, sounds or content, and Soulfia may sometimes be unavailable, for example during maintenance or when a provider has an outage. If we stop offering Soulfia entirely, we will try to give you reasonable notice.
13. Disclaimers
To the fullest extent permitted by law, Soulfia is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that Soulfia will be uninterrupted, error-free or secure, that AI-generated content will be accurate or suitable for you, or that using Soulfia will produce any particular result.
Some places do not allow certain warranties to be excluded. In those places, the exclusions above apply only as far as the law allows, and you keep any rights you have as a consumer that cannot be waived.
14. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, goodwill or other intangible losses, arising out of or relating to Soulfia or these Terms, even if we have been told such damages are possible.
To the fullest extent permitted by law, our total liability for all claims relating to Soulfia or these Terms is limited to the greater of (a) the amount you paid for Soulfia in the 12 months before the event giving rise to the claim, or (b) US$50.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from content you publish or from your breach of these Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be handled by the courts located in the State of Florida, USA, unless the law where you live gives you the right to bring proceedings in your local courts. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
Before starting any formal proceedings, please contact us at roycerobins95@gmail.com so we can try to resolve the issue.
17. Additional terms for the iOS app
If you downloaded Soulfia from the Apple App Store, the following also applies:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Soulfia and its content.
- Your license to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide any maintenance or support for Soulfia.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection or privacy claims, or intellectual property infringement claims.
- You confirm that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- If these Terms conflict with Apple’s Standard EULA on a point about your rights in the iOS app, the Standard EULA controls on that point.
18. Changes to these terms
We may update these Terms from time to time. We will post the new version on this page and update the effective date. If a change is significant, we will also let you know by reasonable means, such as a notice in the app or an email, before it takes effect. If you keep using Soulfia after the changes take effect, you accept the updated Terms. If you do not agree, stop using Soulfia and delete your account.
19. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a provision, that is not a waiver of our right to do so later. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a sale or transfer of Soulfia. These Terms, together with the Privacy Policy, are the entire agreement between you and us about Soulfia.
